Rapidly developing technology and use of the Internet has dramatically changed the way business is done. The technology has expanded business opportunities but also subjected businesses and individuals to much greater risk of copyright infringements and loss of intellectual property and trade secrets. International theft of intellectual property and the creation of art, music, and literature through AI promises new challenges that current law and law-makers will probably be ill-equipped to deal with. It is time for me to leave the daunting challenges ahead to young, eager intellectual property attorneys.

It has been a privilege to practice law for over 50 years and it has been especially satisfying and rewarding to represent artists of all kinds in copyright and trademark infringement matters during the past 12 years of solo practice. Hawaii provides inspiration for an abundance of wonderful art and photography, and I have particularly enjoyed protecting the copyrights of these valued works.
With the move to Internet marketing, and especially “social media marketing” in the last several years there is more demand for great images than ever before, but many commercial marketing departments seem to have forgotten completely about copyright laws. Big companies that previously knew that they needed licenses from the copyright holders and model releases to use images in their commercial advertising and websites seemed to feel free to take any image they could find on the internet and use it to drive traffic to their commercial websites without licensing the images. I did my best to re-educate them to the importance of copyrights.
